ATTORNEY GENERAL BARR OPINES IN WSJ ON NATIONAL INJUNCTIONS | Trump Suggests A Potential DACA Deal

|In The Wall Street Journal, ATTORNEY GENERAL WILLIAM BARR argues for an end to nationwide injunctions which he says are “threatening our democratic system and undermining the rule of law.” He uses the current DACA litigation as an example for his argument. He says that just as compromise appeared possible between Democrats and Republicans in finding a broad solution for Dreamers, a judge in San Francisco entered a nationwide injunction prohibiting the Trump administration from ending DACA. Barr writes, “Far from solving the problem, the DACA injunction proved catastrophic. The program’s recipients remain in legal limbo after nearly two years of bitter political division over immigration, including a government shutdown. A humanitarian crisis—including a surge of unaccompanied children—swells at the southern border, while legislative efforts remain frozen pending Supreme Court resolution of the DACA case.”

|Today, the president suggested on Twitter that if he wins in the upcoming Supreme Court case regarding DACA, he may be open to a bipartisan deal that could benefit Dreamers. The case coming before SCOTUS considers whether the Trump administration illegally tried to end the DACA program. John Wagner with The Washington Post writes, “Democrats are likely to view Trump’s latest overture skeptically. Lower courts have said that Trump’s decision to terminate DACA was based on faulty legal reasoning and that the administration has failed to provide a solid rationale for ending it.”

|David Savage with the Los Angeles Times explains, “The Supreme Court is weighing a fast-track appeal from the Trump administration that seeks to close the door to nearly all migrants who seek asylum at the southern border. And once again, the justices are being asked to decide a far-reaching legal question on a rushed basis, without the usual oral arguments or months of deliberation.” He says that more and more under Trump, the Supreme Court has been making major decisions by weighing in on emergency appeals.
