TRAVEL BAN 2.0 LOSES AGAIN | Only SCOTUS Can Save It
May 26, 2017
BARKING UP THE WRONG TREE...AGAIN
|The president’s travel ban was blocked yet again yesterday with the Fourth Circuit Court of Appeals voting 10-3 to uphold a Maryland judge’s declaration that DONALD TRUMP’S revised travel ban amounted to unconstitutional religious discrimination. The Virginia appeals court found that the new travel ban cannot be enforced on the grounds that it appears to discriminate based on religion and that the administration’s argument that the order was needed to protect national security was a “pretext” offered in “bad faith.” The 10 judges in the majority were all Democratic appointees, while the three judges in dissent were appointed by Republicans.
THE GREATEST HITS
|Cogan Schneier with The National Law Journal delivers us the big hits from the 4th Circuit’s ruling on Trump’s revised travel ban, including the key question of the case and why the court can consider factors other than the order itself.
ONLY SCOTUS CAN SAVE YOU
|Matt Ford with The Atlantic writes that only the Supreme Court can save PRESIDENT TRUMP’S travel ban now. Good thing Trump’s Attorney General JEFF SESSIONS is already on that page, vowing yesterday to take the case straight to SCOTUS. In a statement Sessions said, “President Trump’s executive order is well within his lawful authority to keep the Nation safe. The Department of Justice strongly disagrees with the decision of the divided court, which blocks the President’s efforts to strengthen this country’s national security.”
