|On this day in 1927, the Supreme Court ruled 8-1 in Buck v. Bell and upheld a Virginia law allowing the forced sterilization of people to promote the “health of the patient and the welfare of society.”

|AP reports that although there are no outward signs that JUSTICE ANTHONY KENNEDY plans to retire anytime soon, for some reason liberals are “in a heightened state of anxiety that Kennedy might leave” and conservatives are hopeful that he will. The report suggests, “The speculation reflects the darkest fears and fondest wishes of people who care about the court on both sides of the political spectrum.”
WHOOPS THERE IT IS
|Yesterday, Solicitor General NOEL FRANCISCO notified the Supreme Court in a letter to justices that he misstated the date on which PRESIDENT TRUMP made it “crystal clear” that his travel ban had nothing to do with a campaign promise to ban Muslims. Robert Barnes with The Washington Post reports on the correction and notes, “His letter clarified the date but might not satisfy those who question the ‘crystal-clear’ part.”

ON THE MEND
|Some good news to take us out: JUSTICE SONIA SOTOMAYOR is resting comfortably after her shoulder replacement surgery yesterday. The court said in a statement that the surgery went well and that the justice expects to remain in the hospital for a night or two.
