IN IT TO WIN IT
|Joan Biskupic with CNN provides us with five reasons why JUSTICE ANTHONY KENNEDY is likely to remain on the Supreme Court for the foreseeable future. She notes, “He may be finding more reasons to stay than go, beginning with the fact that he has always lived for this.” Of the five reasons she includes that if Kennedy remains, he’ll get to continue writing the big opinions and making a huge difference from his centrist position on the bench — which gets all the more pronounced in the Trump era.
TELL 'EM WHO'S BOSS
|Nobody likes being told what to do, especially a Supreme Court justice. Tony Mauro with The National Law Journal reports that life-tenured Supreme Court justices don’t like to be told when to retire. If anything, he said, hinting that it is time to go seems to stiffen justices’ resolve to stay.
TWO FIRSTS AT ONE FIRST
|David Lat with Above the Law takes note of JUSTICE GINSBURG’S history-making hiring of a clerk thought to be the first enrolled citizen of an American Indian tribe. Read his update on how Supreme Court hiring is going which, hey, includes a full list of clerks that JUSTICE KENNEDY has hired for October Term 2018.
BETTER BUT NOT GOOD
|Students at the University of Chicago Law School released a report last week on a study that reveals that although some progress has been made, the experiences of female versus male law students are still significantly different in the classroom, in student life, and in their academic achievement. And not exactly different in a good way. The report is titled, “SPEAK NOW: Women, Education and Achievement at The University of Chicago Law School.” (h/t Andrew Hosea)
