|Nina Totenberg with National Public Radio reports that a “nuclear” showdown next week over the nomination of JUDGE NEIL GORSUCH “appears all but inevitable.” It looks like no matter how this shakes out, we’re likely to see a change of the Senate rules. She writes, “A procedural and technical change, for sure. But one that could lead to profound, long-term changes.”

|The justices heard arguments yesterday on the effect of prosecutors not turning over evidence about another potential suspect, revisiting a high-profile murder case from 1984.
TOMORROW AT SCOTUS
|Friday, the justices will consider the Trump administration’s request that the justices indefinitely delay briefing on challenges against an Obama-era environmental rule that broadened the scope of protections according to U.S. waterways. Marcia Coyle with The National Law Journal reports that “it’s neither obvious nor inevitable” that SCOTUS will stand down in the face of “what some observers call indefinite and ambiguous requests for delay.”
NOT BACKING DOWN
|The federal judge in Hawaii who put a national halt on TRUMP’S travel ban just extended his order blocking the ban’s enforcement, putting an even stronger hold on the president’s plan to suspend immigration from six major Muslim countries. This move sets the stage for the Justice Department to appeal to the U.S. 9th Circuit Court of Appeals to reverse the ruling.
CASH OR CREDIT?
|The Supreme Court yesterday threw out a ruling that upheld a New York law barring retailers from charging customers more for using credit cards. The case was sent back down to a lower court to be decided on free speech grounds, not as price regulation.
