ONE MORE CHANCE TO BAN | SCOTUS An Inevitability?

ONE MORE CHANCE
|After enduring a handful of legal defeats across the country, PRESIDENT TRUMP is going back to the drawing board with his travel ban. At a White House news conference yesterday, Trump said he plans to issue a new executive order meant to address some of the legal issues raised by the 9th Circuit in their ruling. “As far as the new order, the new order is going to be very much tailored to what I consider to be a very bad decision,” Trump said of the appeals court ruling blocking enforcement of his ban. He added, “We had a bad court.”
FIX ME
|Jacob Sullum with Reason predicts the three changes we are likely to see in DONALD TRUMP’S revised travel ban. Topping his list: “The new order will explicitly exclude lawful permanent residents from the travel ban.”
MAKING MIRACLES HAPPEN
|Ed Kilgore with New York Magazine says whatever the Trump administration comes up with in its new immigration order, it won’t be able to fix all of Trump’s legal problems. “One problem the administration cannot, however, avoid with a ‘do-over’ is the legal effect of the president’s (and his advisers’) remarks during the 2016 campaign that they wanted to impose a ban on entry to the United States of Muslims.” He also notes, “More than likely, the administration is anticipating an ultimate Supreme Court review of this issue once the new order is released and litigation resumes.”
THEME OF THE DAY
|The Supreme Court will hear three cases in the coming months that could set guidelines for how the Trump administration can treat non-citizens in the United States. Each of the cases deals broadly with the rights of non-citizens under the Constitution, and all will come before a shorthanded court of eight. Lawrence Hurley with Reuters reports on the cases and their possible effects on immigration law in this country.
BAD HOMBRES
|While Immigration and Customs Enforcement (ICE) officers sweep up mothers and young people with no major crimes on their records, immigrant families across the country are terrified of their futures. David Horsey in the Los Angeles Times opines that before the government scoops up thousands of people who are “far from being criminals,” we should consider the ways in which they “exemplify the American dream.”
